Rape of Anene Booysen

Anene Booysen (October 30, 1995 - February 2, 2013) was a 17-year-old girl who was found by a security guard the morning after she had been gang-raped and disemboweled by having her abdomen slit open at a construction site in Bredasdorp, in the Western Cape, South Africa on February 2, 2013; she was still alive, but died later in the day.

Rape and murder

Anene Booysen was found by a security guard lying a short distance from her house after partying at a bar on the evening of February 1, 2013. She died from her injuries in hospital six hours later. She managed to identify one of her attackers before her death.

Reaction

South Africa's President Jacob Zuma has condemned the attack as "shocking, cruel and most inhumane". The Congress of South African Trade Unions (Cosatu), South Africa's biggest labour union, called for mass action over rape in South Africa. Opposition parliamentary leader Lindiwe Mazibuko called for parliamentary hearings. The United Nations issued a statement strongly condemning the rape and murder. On 13 February, a protest, led by Annie Lennox, was staged at St. George's Cathedral, Cape Town.

Booysen and Reeva Steenkamp, both young South Africa women killed in 2013, were named SA Persons of the year 2013 by Daily Maverick.

Funeral

A funeral was held at the Dutch Reformed Church in Bredasdorp, about 128 km east of Cape Town on February 9, 2013.

Prosecution

Johannes Kana was convicted for the crime, and sentenced to two consecutive life sentences.

Johannes Kana was on Friday sentenced to two life sentences for the rape and murder of Anene Booysen.

The sentencing of Kana was on Wednesday postponed in the Swellendam Circuit Court to Friday.

On Tuesday, Judge Patricia Goliath found Kana guilty of raping and murdering Booysen.

Booysen was raped and disembowelled, and died in Tygerberg Hospital, Cape Town, on the afternoon of February 2.

Kana was seen with Booysen outside a Bredasdorp pub in the early hours of that day.

Pieter du Toit, for Kana, said his client was under the influence of alcohol and the crime was not planned.

He also reportedly said Kana had admitted guilt and apologised, and was also helpful with the investigation.

Du Toit asked that sentencing should run concurrently. The state has asked for a life sentence for both counts.

'Maximum sentence of life imprisonment'

Before Wednesday's court proceedings, the National Prosecuting Authority (NPA) spokesperson Eric Ntabazalila said, "We will ask for a maximum sentence of life imprisonment."

The NPA welcomed Kana's conviction on both charges in the court.

"We are happy that the court came to the conclusion, as we have argued over the past eight months that the only person who was responsible for the rape and murder of Anene Booysen was Johannes Kana."

Wednesday would have been Booysen's 18th birthday, according to Ntabazalila.

"We are now going to be asking the court to impose a life imprisonment to ensure that we deliver justice for Anene, her family, her friends and the community of Bredasdorp."

The NPA commended the work of the investigating and prosecuting teams that worked to finalise the case within eight months.

Five or six men were involved

It was previously reported that Booysen said from her hospital bed that five or six men were involved in the attack.

Initially, Kana, Jonathan Davids and another man were arrested.

Charges were later withdrawn against Davids and the other man because of insufficient evidence.

Before she died, Booysen named one of her assailants as "Zwai", which was both the nickname of Davids and another man said to live in Zwelitsha.

Ntabazalila said: "We have argued in court that not too much weight must be put on the name of Zwai ... that was mentioned by Anene Booysen while she was in hospital".

"We have argued that Anene Booysen was in terrible pain, under the influence of alcohol, under medication."

Scratch marks and blood

He said Davids had scratch marks and blood on one of his shoes, but had an explanation for this.

"His clothes and those of Kana were taken for forensic testing. The results did not implicate him."

Davids also had an alibi for the morning of the rape and murder.

"The state withdrew the charges against him as there was no evidence linking him to the rape and the murder."

South Africa Rape Victim Anene Booysen Was Disembowelled By Hand

A South African teenager who was raped and murdered earlier this year was disembowelled with a blunt object, possibly by hand, leaving over a metre of her small intestines protruding from her vagina, a court has heard.

Anene Booysen's death in February caused widespread anger over violence against women in South Africa, with president Jacob Zuma calling the attack "shocking, cruel and most inhumane".

She was found at a construction site near her home in Bredasdorp in the Western Cape by a security guard. She had been raped and mutilated and died six hours later in hospital.

Initially two men were arrested for the attack but one, her ex-boyfriend Jonathan Davies, later had all charges against him dropped.

The other accused Johannes Kana admitted, in his trial at Swellendam Circuit Court, to leaving the pub with Booysen on the night of the attack. He hit her and raped her but denies murder. "I pulled down her pants ... kicked her ... and raped her," he said in a statement.

The doctors treating Booysen described her horrific injuries to the jury at the trial.

According to Eyewitness News, Dr Elizabeth De Kock, who was first to attend to Booysen when she was brought into hospital, said her injuries were the worst she had ever seen and that she could not have been saved due to the massive injuries sustained to her intestines.

She said she was covered from head to toe in sand and blood and had bruises all over her body. She said a sharp object had been used to mutilate her genitalia and that her intestines may have been pulled from her vagina by hand.

Kana reprimanded

De Kock added that she could not tell if the injuries had been cause by more than one person - it was initially believed Booysen had been gang raped before her death.

Pathologist Karisha Quarrie, who examined Booysen's body after her death, said the cause of death was her mutilated genital area: "All injuries were consistent with a blunt object such as a brick, baseball bat or stick," South Africa's Times Live newspaper reported.

She said there were signs of accelerated decomposition to her intestines and excessive damage to her anus wall, indicating a great deal of force was used: "The intestines appeared to have already died while she was alive.

"The large intestines, which are attached to the stomach wall, were still inside the body but 1.2m of the small intestines were outside the body through the vagina."

While presenting their evidence, Kana was reprimanded by the judge for showing little interest in the details of Booysen's injuries.

Swellendam Circuit Court interpreter Aubrey Jonase, who was translating the case into Afrikaans on Kana's behalf, said: "He is not even listening. What is the point if he is not listening?"

Speaking to the accused, Judge Goliath said: "Mr Kana, would you please show some enthusiasm and appreciation?"

So far 15 of the 52 witnesses have testified at the trial, which is expected to finish by the end of October. If found guilty, Kana faces life imprisonment.

 
 

Grisly Anene Booysen discovery described

Cape Town - Three witnesses testified on the first day of the Anene Booysen rape and murder trial in the Swellendam Circuit Court on Monday, according to reports.

The Cape Times reported that Riaan Scheepers, a friend of the accused, Johannes Kana, testified that he saw Kana, 21, and Booysen, 17, leaving a pub in Bredasdorp on the night of 1 February this year.

Scheepers later testified that he saw Kana soon after his arrest, and Kana told him he was "sorry" and that "he did it". However, the defence stated that this confession had not been included in the State's submissions, and it was unclear if he was referring to the rape or murder of Booysen.

Die Burger reported that the security guard on duty at the construction site where Booysen was found testified that he heard a scream while patrolling the area at about 04:00 on 2 February. He called his supervisor and the police and they then discovered Booysen lying on the ground with her intestines visible.

A police constable testified in court that he drove his van to the site and shone the headlights on Booysen. He found her lying on her back, with her pants pulled down to her knees and her intestines hanging out. Her eyes were swollen shut and she was groaning in pain.

An ambulance was called and Booysen was transported to hospital, where she died later that afternoon.

Kana was formally charged with Booysen's rape and murder in court on Monday. In his plea he admitted hitting and raping Booysen, but denied killing her.

 
 

‘I assaulted and raped Anene’

Bredasdorp – The State says one of the men alleged to have raped and murdered Bredasdorp teen Anene Booysen has confessed to raping and assaulting her, but not to killing her.

Investigating officer Warrant Officer Edmund Abels told the Bredasdorp Magistrate’s Court on Tuesday that Johannes Kana, 21, would not be applying for bail as he confessed to raping and assaulting Anene.

Outside court, NPA spokesman Eric Ntabazalila confirmed that Kana confessed to his part in the crime and that witnesses had seen him with Anene on the night of her murder.

Booysen was found on February 2, gang-raped and disembowelled, at a construction site not far from her home.

“He confessed his involvement in the crime and forensic tests are being carried out on his clothing and shoes. The State are still awaiting the results.”

Co-accused Jonathan Davids, 22, pleaded not guilty and his bail application began on Tuesday in a packed courtroom.

Police cordoned off the road leading to the court. There was also a heavy police presence inside court.

Davids took the stand and said he had been to the same pub as Anene on the night of her murder, but had only greeted her.

He said he left the pub with friends and went home. Once there he went to buy a box of wine and then drank it with his friends, before going to bed.

“I knew Anene very well and used to live with them for four to five months. My nickname is Zwai.”

Anene had allegedly uttered the name Zwai before she died.

Under cross-examination he said he’d heard of another person with the same nickname. “I heard that he is a 28’s gangster and lives in the Zwelitsha township, but I don’t know him.”

When prosecutor Maria Marshall asked him about scratch marks on his arm and neck on the day he was arrested he said he had fallen.

Davids told the court that he should get bail because he was not guilty.

Abels said Anene had pointed out Zwai as the perpetrator.

“Before she died she told three different medics that it was Zwai and his friends. And according to Anene’s mom, Zwai… is the only Zwai she had known. Davids lived with the family and according to her foster mother was like a child in the house. He lived with them at one stage.”

Abels said police could not rule Davids out as a suspect, and that possible blood and semen were found on his shoes and trousers.

Defence attorney Pieter Du Toit, Abels said he wasn’t sure whose clothes the semen and blood were found on.

“At the moment there is a strong case against the accused. We are waiting for the forensic results and can’t say whose clothes it was found on,” said Abels.

The court heard that Davids had a previous conviction from 2005 for theft, for which he received a suspended sentence of five years.

Also, three cases of assault had been brought against him, but had been withdrawn. Two of the cases had been opened by men and the third by a woman.

Cross-examined about another man with the nickname “Zwai”, Abels said police had searched for him. “We were told he left the area a month before the incident.”

However, he admitted police had searched for the second “Zwai” for only 30 minutes.

He also admitted that the only thing linking Davids to the case was his nickname and possible evidence on his clothes.

 
 

Aunt tells of horror injuries

The rage of Bredasdorp residents over the gang-rape, murder and mutilation of 17-year-old Anene Booysen is at boiling point, and they have threatened to take the law into their own hands if they find more suspects.

So far two men have been arrested – Jonathan Quinton Davids, 22, and a second man, who is expected to appear in court on Friday.

It is estimated that in South Africa every hour 150 men carry out rapes.

This staggering figure is an estimation of:

* The 144 rapes reported to the police every day.

* The Medical Research Council’s latest research that reveals that only one in 25 women in Gauteng report rape.

This adds up to 3 600 rapes a day.

Davids appeared in the Bredasdorp Magistrate’s Court on Tuesday on charges of rape and murder.

The community threats come as new details about the extent of Anene’s injuries emerge.

Independent Newspapers visited Anene’s family at the Simunye RDP development outside Bredasdorp on Thursday.

Wilma Brooks, Anene’s aunt, wept when the question of Anene’s injuries arose. After half a minute’s silence, she spoke.

“Her throat had been slit, all her fingers and both legs were broken, a broken glass bottle had been lodged in her, her stomach had been cut open… That which was supposed to be inside her body lay strewn across the scene where they found her.”

Anene was left for dead at a construction site near her home. It’s believed her attackers had followed her as she was walking home from a sports bar on Friday night. She was taken to hospital in Bredasdorp, transferred to Worcester and then to Tygerberg, where she died on Saturday afternoon.

Independent Newspapers found Anene’s mother, Corlia Olivier, at a relative’s house.

With tears in her eyes she spoke of her relationship with her daughter, who worked as a cleaner for Asla Construction.

“We were mother and daughter, but we were also best friends. She was so helpful – with her around I didn’t need a man in the house. She worked hard and helped to buy food, we shared everything.”

After years of separation because of financial difficulties, Olivier and Anene had been living together in their newly built RDP house for just two months.

“She was everything to me, and such a joyous person. I can’t recall that I ever lost my temper with her. She was just too sweet,” said Olivier.

On the morning after the attack Olivier visited her daughter at Otto du Plessis Hospital in Bredasdorp.

“From the moment I entered the door I could hear her screaming: ‘Mother, mother please help me’ – without her knowing that I had come.

“I walked up to her bedside and saw what they had done to my girl.”

Mom and daughter shared their final words there, before Anene was transferred to Worcester.

Today Anene’s room remains as she left it: meticulously tidy, with Michael Jackson posters on the wall and flowers everywhere.

“At night when it gets quiet and I am alone is when I will miss her the most. We always used to joke that we don’t need a TV, because we had each other. I think I may have to get one now,” said Olivier.

Meanwhile, the community has expressed outrage at her murder. Some threatened to attack the police van bringing the suspects to court for their next appearance.

“As a community we have to do something to bring this crime against girls and women to an end,” said Sara Mageni, whose six-year-old daughter was similarly raped and assaulted with a broken bottle four years ago.
